Superior Court confirms insurance applicant’obligation to disclose customary operators.

Superior Court Justice Kathleen McCarthy’s decision in Holzberg v. Metlife Auto and Home, 1877 CV 00558, confirms an insurance applicants obligation to disclose a prospective operator of an insured vehicle on a personal automobile insurance application in order to place the insurer on notice of the potential risk posed by the undisclosed operator. Jantzen & Associates, P.C. secured summary judgment for Metlife Auto & Home, obviating any obligation to provide coverage to the insurance applicant. You can find the decision here.
